In this paper the authors explore the association between student predispositions to be either deontological or utilitarian and issue involvement. The suggestion is made that those who are more utilitarian/outcome driven will tend to be less involved with issues overall, but more likely to be persuaded by strong argument, than those who are more deontological/values driven. The results of an empirical examination into this conjecture are offered and discussed.

Bioethical dilemmas can emerge in research and clinical settings, from end-of-life decision-making to experimental therapies. The COVID-19 pandemic raised serious ethical challenges for healthcare organizations, highlighting the need to conduct needs assessments of the bioethics infrastructures of healthcare organizations. Clinical ethics committees (CECs) also create equitable policies, train staff on ethics issues, and play a consultative role in resolving the difficulty of complex individual cases. The main objective of this project was to conduct a needs assessment of the bioethics infrastructure (...) within a comprehensive hospital system. A cross-sectional anonymous online survey, including quantitative and qualitative formatted questions. The survey was sent to five key leaders from the organization’s hospitals. Survey questions focused on the composition, structure, function, and effectiveness of their facilities’ bioethics infrastructure and ethics-related training and resources. Positive findings included that most facilities have active CECs with multidisciplinary membership; CECs address critical issues and encourage team members to express clinical ethics concerns. Areas of concern included uncertainty about how CECs function and the process for resolving clinical ethics dilemmas. Most reported no formal orientation process for CEC members, and many said there was no ongoing ethics education process. The authors conclude that if CECs are a critical institutional resource where the practice of medicine and mission intersect, having well-functioning ethics committees with trained and oriented members demonstrates an essential commitment to the mission. The survey revealed that more needs to be done to bolster the bioethics infrastructure of this institution. (shrink)

Kendall Walton says that photographs are “transparent” . By this he means that “we see the world through them” . That is,With the assistance of the camera, we can see not only around corners and what is distant or small; we can also see into the past. We see long deceased ancestors when we look at dusty snapshots of them…. We see, quite literally, our dead relatives themselves when we look at photographs of them. [Pp. 251, 252]Walton is explicit on (...) one point: he does not mean merely that we have the impression of seeing ancestors, or that photographs supplement vision, or that they are duplicates or reproductions or substitutes or surrogates. Rather, “the viewer of a photograph sees, literally, the scene that was photographed” . In what follows I will urge that Walton’s argument for this view is insufficient.Walton is led to his conclusion by an account of the nature of seeing. He claims that “part of what it is to see something is to have visual experiences which are cause by it in a purely mechanical manner” . The mechanical connection is important here. For “to perceive things is to be in contact with them in a certain way. A mechanical connection with something, like that of photography, counts as contact” . Paintings and other “handmade” representations fail to have the required mechanical connection; they are humanly mediated rather than mechanically produced. Consequently, Walton thinks, paintings are not transparent. On the other hand, “objects cause their photographs and the visual experiences of viewers mechanically.” And “so we see the objects through the photographs” . Without guidance, students typically overestimate their understanding and memory of learning materials, which can have detrimental effects on the learning process. However, most students do not receive guidance or instruction about how to study. Moreover, students are largely unaware of strategies to self-regulate their learning and study effectively. Research has shown that prompting both cognitive and metacognitive strategies is effective to support self-regulated learning. Therefore we developed a mobile application, the Ace your self-study app, to prompt both cognitive and metacognitive (...) strategies to support learning processes. In this article a theoretical background, description of the app’s features and design choices are presented. Also, data from the application in presented to give provide an idea of how the app has been used. (shrink)

In the faculty of arts at the University of Padua in the years around 1600 professors debated the reliability of astrology, the existence of occult celestial influences, and the idea that celestial heat is present in living bodies. From the 1570s to the 1620s many professors in the faculty of arts pushed back against astrology and Jean Fernel's theories surrounding astral body. Girolamo Mercuriale, Alessandro Massaria and Eustachio Rudio thought that some forms of astral causation and Fernel's ideas were incompatible (...) with their observations of disease, Aristotle's philosophy and Hippocratic theories. Later, Santorio Santorio and Cesare Cremonini, who were allied to the political circle of Paolo Sarpi, polemicized against astrology. Their writings show that at Padua medical theory was linked to Aristotelian cosmology, which emphasized the incommensurability between celestial and terrestrial elements. Their rejection of astrology, however, did not lead to the complete marginalization of astrology at Padua. By the middle of the 1620s, as the political climate changed in Venice, the University of Padua hired professors who promoted astrology and Fernel's theories about the celestial nature of innate heat. The diversity of opinions about astrology reflected Venice's divided politics and multiple approaches to interpreting Aristotle and other authorities. (shrink)

The well-established finding that siblings growing up in the same family turn out to be very different from one another has puzzled psychologists and behavior geneticists alike. In this theoretical note we describe the possible ontogeny and phylogeny of a sibling differentiation mechanism. We suggest that sibling competition for parental investment results in sibling differentiation on a number of characteristics, producing different developmental trajectories within families. Variations in developmental trajectories within families may have had fitness advantages in ancestral environments because(a) (...) sibling competition for extrafamilial resources would be reduced and(b) these variations would be suited to environments containing a variety of niches or to changing environments. Predictions derived from this model and an example of an application to attachment theory are presented. (shrink)

Talk of 'spirituality' and 'individual religion' is proliferating both in popular discourse and scholarly works. Increasingly people claim to be 'spiritual but not religious,' or to prefer 'individual religion' to 'organized religion.' Scholars have for decades noted the phenomenon - primarily within the middle class - of individuals picking and choosing elements from among various religious traditions, forming their own religion or spirituality for themselves. While the topics of 'spirituality' and 'individual religion' are regularly treated as self-evident by the media (...) and even some scholars of religion, Capitalizing Religion provides one of the first critical analyses of the phenomenon, arguing that these recent forms of spirituality are in many cases linked to capitalist ideology and consumer practices. Examining cases such as Eckhart Tolle's The Power of Now, and Karen Berg's God Wears Lipstick, Craig Martin ultimately argues that so-called 'individual religion' is a religion of the status quo or, more critically, 'an opiate of the bourgeoisie.' In this paper I describe the context and goals of Francisco Vallés' In IV librum Meteorologicorum commentaria. Vallés' work stands as a landmark because it interprets a work of Aristotle's natural philosophy specifically for medical doctors and medical theory. Vallés' commentary is representative of new understandings of Galenic-Hippocratic medi-cine that emerged as a result of expanding textual knowledge. These approaches are evident in a number of sixteenth-century commentaries on Meteorologica IV; in particular the works of Pietro Pomponazzi, Lodovico Boccadiferro, Jacob (...) Schegk, and Francesco Vimercati. Vallés' conviction that Meteorologica IV is relevant to medical knowledge depends on his understanding of Aristotle's theory of homeomerous substances and their relation to composite substances. The application of Meteorologica IV to medical topics became commonplace in the following years, and this Aristotelian book became widely known as a bridge between natural philosophy and medicine. What causes winds was regarded as one of the most difficult questions of early modern natural philosophy. Vitruvius, the ancient Roman architectural author, put forth an alternative to Aristotle’s theory by likening the generation of wind to the actions of the aeolipile, which he believed made artificial winds. As Vitruvius’s work proliferated during the sixteenth and seventeenth centuries, numerous natural philosophers, including Descartes, used the aeolipile as a model for nature. Yet, interpretations of Vitruvius’s text and of the relation of (...) the aeolipile to natural winds varied according to definitions and conceptions of air, wind, rarefaction, condensation, and vapor. The context and caption of a photograph often suggest that the content described is real. When this happens an assertion is made?at least implicitly. Newspapers provide such a context, and viewers naturally understand news photographs assertively. If in such a context, the content described is not real, then the viewer is likely to be deceived. Willful viewer deception is practiced by photographers in a variety of common situations in which it is unjustifiable.

As computer technology develops, elements in photographs can more easily be rearranged with undetectable changes, offering broad opportunities to alter the reality depicted in photos. This article looks at some contexts in which photographs have been altered and explores moral complications in determining standards for manipulation that center on a concept of deception and credibility.

There is still very little constitutional control over the decision to use armed force, and very limited domestic implementation of the international principles of jus ad bellum, notwithstanding the increasing overlap between international and domestic legal systems and the spread of constitutional democracy. The relationship between constitutional and international law constraints on the use of armed force has a long history. Aspects of constitutional theory, liberal theories of international law, and transnational process theory of international law compliance, suggest that constitutional (...) design could legitimately be used as a pre-commitment device to lock-in jus ad bellum principles, and thereby enhance compliance with that regime of international law. This paper examines the case of Japan's Constitution to determine the extent to which its war-renouncing provisions incorporated, and are consistent with, international law principles on the use of armed force, and whether the provisions operated to effectively constrain government policy. It concludes that the drafters of the Constitution did incorporate international law principles from jus ad bellum in Art. 9(1), though they also grafted on sui generis prohibitions and rules from jus in bello in Art. 9(2) as well, which complicates the story. The provision was embraced in the ratification process, and became the source of powerful constitutive norms that have helped shape Japan's sense of identity. The paper examines the interpretation of Art. 9, as informed by international law, and concludes that despite deep conflicts over competing narratives and understandings of the provision, the long-standing government interpretation of the provision is consistent with Japan's obligations under the jus ad bellum regime. In looking at the operation of Art. 9, the paper finds that despite the early use of Art. 9 by governments as a pretext behind which it could pursue desired policy objectives, the provision did operate to effectively constrain government policy in times of apparent crisis. During the Gulf War in particular, Art. 9 effectively bound a straining government to the mast, preventing Japan's participation in the war. It did so not only in its operation as a legal norm, effectively enforced by the Cabinet Legislation Bureau, but also as a powerful constitutive and social norm. As such, the experience of Japan with Art. 9 provides support for the argument that it is feasible to incorporate principles of jus ad bellum into national constitutions, so as to effectively constrain government policy with respect to engaging in armed conflict. Broader arguments as to why that might be desirable, or whether it has served Japan well or ill, are left for another day. (shrink)

ABSTRACT It is well attested that Francis Bacon considered his History of Winds to be an exemplar, but what lessons should be taken from its example have been subject to debate. Instead of looking at this work as a mere model for the fusion of natural history and natural philosophy, it is also possible to see Bacon as trying to provide tentative solutions to outstanding questions regarding the wind, a topic that was deeply scrutinized during the early modern period. An (...) examination of Bacon’s provisional concluding rules reveals deep correspondences with earlier works, such as José de Acosta’s Natural and Moral History of the Indies, that revised classical understandings of the wind based on experience, experiments, and accounts of travels beyond Europe. Understanding the History of Winds as a genuine attempt to solve outstanding questions about the wind uncovers its debt to earlier traditions, including those related to Renaissance natural history, and shows it’s influence in relation to specific theories of the wind beyond its call for methodological reform. The subject of meteorology was central to Girolamo Cardano’s thought. It held together his encyclopedism by tying the celestial realm to the sublunary world and human action. Meteorology, for Cardano, links abstract knowledge to the practical and operative. While many of his Aristotelian predecessors understood weather prediction as distinct from meteorology as a natural philosophical field, Cardano’s profound interest in conjectural arts and probabilistic reasoning led him to tie causal explanations to methods of forecasting future conditions of the air and (...) their effects on humans, especially regarding health and disease. While it might be expected that Cardano would have emphasized astrological tools for weather forecasting, instead he went in a different direction, namely, embracing the ancient tradition of weather signs and revising Aristotelian theories of winds. At the end of his career, which he mostly spent writing commentaries on Hippocratic writings, he integrated his understanding of weather signs with Hippocratic rules of prognosis, revising traditional understandings of the causes of winds. Those of us who study the history and politics of the concept of religion and its related terms often find that our peers in adjacent disciplines or subdisciplines do not take into account our findings and continue to use the terms naively and unreflexively. Perhaps this is because they are unaware of the problematic norms knotted into the history of the concept or the contested political stakes involved in its use. Or, perhaps they are engaged in just the very sort (...) of politics our subdiscipline documents. When discussing this with one of the editors of CRR, he asked me to outline why those not engaged in the historicization of the concept of religion should take our work into account. How or why would a contemporary sociologist of religion benefit from reading, for example, a discourse analysis of Reformation-era theologico-political rhetoric? To that end, here I put forward the following theses on the critique of the concept of religion, making the case, as boldly and as succinctly as I can, why our work is relevant to all who write on “religion,” and provide references to the essential literature on the subject for those who wish to pursue further reading on the matter. The fregean theory of meaning says how the meaningful parts of a meaningful expression contribute to that expression's sense and reference. But frege overlooks the fact that logical expressions play dual roles. The contributions of sentential connectives, For example, Are well described for contexts in which they connect sentences, But not for larger quantificational contexts. An obvious modification of the theory which might fill the abyss is considered, And it is maintained that it produces two difficulties: a replication of frege's (...) concept 'horse' troubles and an infinite proliferation of logical vocabulary. The Divide between the prominence of final causes in Aristotelian natural philosophy and the rejection or severe limitation of final causation as an acceptable explanation of the natural world by figures such as Bacon, Descartes, and Spinoza during the seventeenth century has been considered a distinguishing mark between pre-modern and modern science.1 Admittedly, proponents of the mechanical and corpuscular philosophies of the seventeenth century were not necessarily stark opponents of teleology. A main thrust of much of Quine's work is that meaning, belief, desire, motive and other so-called “intentional phenomena” are under-determined by all possible evidence: the totality of possible evidence could not determine whether two persons meant, believed, desired, or had as motives the same thing. One way to identify a person's beliefs, desires and motives is to frame a theory of his meanings, for then we could ask him what he believed and desired; this will be a theory of (...) translation for his language. But such a theory of meaning, according to Quine, is also not uniquely determined by all the evidence.
